The first issue of _Artificial Intelligence and Law_ journal was published in 1992. This paper discusses several topics that relate more naturally to groups of papers than a single paper published in the journal: ontologies, reasoning about evidence, the various contributions of Douglas Walton, and the practical application of the techniques of AI and Law.

Despite increasing interest in studying arguments from deontic authority of the general form “(1) $$\delta$$ δ is a deontic authority in institution $$\varOmega$$ Ω ; (2) according to $$\delta$$ δ, I should do $$\alpha$$ α, C: therefore, (3) I should do $$\alpha$$ α ”, the state of the art models are not capable of grasping their complexity. The existing sets of critical questions assigned to this argumentation scheme seem to conflate two problems: whether a person is subject to an authority (...) of an institution in the first place and whether the command issued within the context of a particular institution is eventually binding. For this reason, we introduce (1) a set of Basic Critical Questions to scrutinize the former issue, and (2) a set of more detailed questions related to specific features, also referred to as “parameters”, of institutional environments (Intra-Institutional Critical Questions). We identify major elements of institutional environments in which authoritative utterances are made and the crucial parameters of arguments from deontic authority. The selected evidence from the decisions of the Polish Supreme Administrative Court helps us show how these parameters may be used to reconstruct subtypes of this argument scheme, with their associated sets of critical questions. In specific institutional contexts, such detailed schemes are capable of grasping the complexity of appeals to deontic authority and thus should be used rather than general schemes. The reconstruction of argumentation schemes with critical questions shows how particular arguments may successfully be attacked. (shrink)

The first issue of Artificial Intelligence and Law journal was published in 1992. This paper offers some commentaries on papers drawn from the Journal’s third decade. They indicate a major shift within Artificial Intelligence, both generally and in AI and Law: away from symbolic techniques to those based on Machine Learning approaches, especially those based on Natural Language texts rather than feature sets. Eight papers are discussed: two concern the management and use of documents available on the World Wide Web, (...) and six apply machine learning techniques to a variety of legal applications. This is a report on the Doctoral Consortium co-located with the 17th International Conference on Artificial Intelligence and Law in Montreal.

This monograph by Prof. Karapetyan is an ambitious effort aiming at discovery of the concept of dual unionism as a universal element of the material world, human spirituality and philosophical consciousness, and therefore, of the mega-paradigmal principle of philosophy.

The thesis of the paper holds that some future developments of argumentation theory may be inspired by the rich logico-methodological legacy of the Lvov–Warsaw School (LWS), the Polish research movement that was most active from 1895 to 1939. As a selection of ideas of the LWS which exploit both formal and pragmatic aspects of the force of argument, we present: Ajdukiewicz’s account of reasoning and inference, Bocheński’s analyses of superstitions or dogmas, and Frydman’s constructive approach to legal interpretation. This paper (...) does not aim at exhaustive elaboration of any of these topics or their usefulness in current discussions within argumentation theory. Rather, we intend to indicate chosen directions of a potentially fruitful research program for the emerging Polish School of Argumentation which would consist in application of methods and conceptions elaborated by the LWS to selected open problems of contemporary research on argumentation. The article attempts to analyze Feliks Koneczny’s beliefs about paedocracy in the context of presently observed forms of youth political activity. For this purpose, the paper offers a discussion of selected texts on paedocracy published by Koneczny in the Słowo daily between September 16 and October 22, 1912. At that time, Koneczny wrote: “O pajdokracji” [On Paedocracy], “Partenogeneza pajdokracji” [Partenogenesis of Paedocracy], “Pajdokracja z prowokacji” [Provoked Paedocracy], “Młodzież jako środek reklamy” [Youth as a Means of Advertising], “Młodzież jako rzekoma (...) rękojmia przyszłości” [Youth as the Supposed Guarantor of the Future], “Pajdokracja i apatia” [Paedocracy and Apathy], “Stronnictwa a pajdokracja” [Parties and Paedocracy], “Brak pajdokracji w Wielkopolsce” [No Paedocracy in Greater Poland], “Patryjotyzm bez zajęcia” [Jobless Patriotism] and “Szacunku dla młodzieży” [Respect Youth]. Based on the analysis of source texts, the definition of paedocracy is presented on to of its causes and effects. This information is juxtaposed with other takes on paedocracy and its contemporary faces. Koneczny’s assessment of paedocracy was unequivocally negative. He believed it was socially harmful and resulted from a number of misconceptions. “Youth rule”, in the scholar’s view, is inspired solely by mature politicians who manipulate the young to achieve their own agendas. Such behavior stems from the lack of respect for youth that Koneczny clearly sought. The researcher saw many advantages of young Poles, but at the same time he was aware that some features of youth are not desirable in politics. He concluded that the only way to combat paedocracy might be to remove the young from politics altogether. At the same time, he realized that such a radical solution was not possible. In his argument, Koneczny not only described the flaws of paedocracy, but also showed how it can be combatted. (shrink)

The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. This book presents the current state of the art regarding the application of logical tools to the problems of theory and practice of lawmaking. It shows how contemporary logic may be useful in the analysis of legislation, legislative drafting and legal reasoning concerning different contexts of lawmaking. Elaborations of the process of lawmaking have variously emphasised its political, social or economic aspects. Yet despite strong interest in logical analyses of law, questions remains about the role of logical tools in lawmaking. (...) This volume attempts to bridge that gap, or at least to narrow it, drawing together some important research problems-and some possible solutions-as seen through the work of leading contemporary academics. The volume encompasses 20 chapters written by authors from 16 countries and it presents diversified views on the understanding of logic (from strict mathematical approaches to the informal, argumentative ones) and differentiated choices concerning the aspects of lawmaking taken into account. Building on our diverse research traditions in the study of reasoning, language and communication, the Polish School of Argumentation integrates various disciplines and institutions across Poland in which scholars are dedicated to understanding the phenomenon of the force of argument. Our primary goal is to craft a methodological programme and establish organisational infrastructure: this is the first key step in facilitating and fostering our research movement, which joins people with a common research focus, complementary skills and an enthusiasm to work (...) together. The aim of this thesis is to describe contemporary cultural problems in Europe using the category of historiosophy developed by Feliks Koneczny. The author discusses the division of civilisations in Europe as described by Koneczny and his ‘historical laws’ which concern mutual relations between these civilisations. Nowadays, Europe is an area where five civilisations mix. One of them has appeared in Europe due to the mass migration of the Muslim population. According to Koneczny, there can be no synthesis between (...) civilisations and only a mixture of civilisations can emerge which will lead to an anti-civilisational status or a war. The current situation in Europe requires serious correction. The paper refers to a multi-civilisational phenomenon that was the Polish‑Lithuanian Commonwealth. Its two main pillars were a strong identity of the state and respect for civilisational minorities. The model of the Polish-Lithuanian Commonwealth seems to be the best solution for the present problems of the European Union. (shrink)

We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. As a whole, the subsections build into (...) a history of the last quarter century of the field, and provide some insights into where it has come from, where it is now, and where it might go.
